Creator Guidelines

Creator Affiliate Program

We're a female-founded, family-run cocktail company in South Jersey, stocked in 87+ Whole Foods doors across 11 states. Every one of our eight bottled cocktails has medaled at national spirits competitions.

Creators in our program earn 10% commission on every order their link drives, tracked automatically with no code for their audience to remember. Your audience gets free shipping at three bottles instead of our usual $75 minimum.

No mixing, no measuring — pour over ice and it's done, which makes for short, easy content.

What we're looking for

  • You're 21 or older and based in the United States
  • Your audience is predominantly 21 or older
  • You make food, drink, or entertaining content
  • You'll disclose the partnership clearly on every post

We review every application and reply either way. Please read the guidelines below before you apply — they cover how we ask creators to describe our cocktails, which matters because we sell a regulated product.

Creator Content Guidelines

How to talk about our cocktails accurately, and what we need from every creator who works with us.

About this page: These guidelines are informational and may change as our program evolves. They describe how we ask creators to represent our products. Approved creators receive our full program details at onboarding. Note that disclosure obligations under FTC rules apply to you independently of anything on this page.

If you're ever unsure whether you can say something, ask us first at hello@drinkbrodys.com. We would much rather answer a question in advance than ask you to edit a live post.

Who can join

  • You must be 21 or older
  • You must be a U.S. resident
  • Your audience must be predominantly 21 or older

Where we ship. We ship direct-to-consumer to 37 states and the District of Columbia. We currently cannot ship to Alabama, Alaska, Arkansas, Hawaii, Maine, Maryland, Michigan, Mississippi, Montana, Nebraska, New Hampshire, North Dakota, or Virginia. Please keep this in mind when planning content, and never promise delivery to an audience we can't serve.

Disclosure — this one is not optional

Federal law requires you to disclose your relationship with us. Under the FTC's Endorsement Guides, both you and Brody's are responsible for undisclosed endorsements, so we hold a firm line here.

Every post, story, video, or article featuring Brody's needs a clear and conspicuous disclosure.

  • Use #ad, #affiliate, or #sponsored, placed at the beginning of your caption — not buried at the end of a hashtag block
  • On video, say it out loud or place it on screen where it's readable, in addition to the caption
  • On stories, put the disclosure on the same frame as the product, not a separate frame
  • Platform tools (Instagram's "Paid partnership," TikTok's branded content toggle) are welcome but don't replace an in-caption disclosure
  • Vague terms — "collab," "partner," "thanks," "sp," "ambassador" — are not sufficient on their own

If a post is missing a disclosure, we'll ask you to add or edit it.

Talking about our products

Our cocktails are a regulated product, and inaccurate claims create real problems for both of us. These rules are firm.

Ingredients — the important part

You can say: made with natural flavors · all-natural flavors · no artificial flavors · no artificial coloring · real spirits

Please don't say: made with real fruit · real fruit juice · fresh-squeezed · fresh herbs · freshly pressed · contains juice

Why: our cocktails are shelf-stable and contain no perishable ingredients. Describing any flavor as a physical ingredient isn't accurate.

Describing taste is completely fine. Talk about how it smells and tastes as much as you like. "Bright lime and garden mint on the nose" describes your experience. "Made with fresh mint and real limes" states an ingredient. The first is great; the second isn't accurate.

A pattern that works well: "a [spirit] cocktail with [flavor], [flavor], and [flavor] notes."

Product-specific notes

Product What to know
Air Mail Honey is a tasting note only — there's no honey in the product. Never describe it as containing or made with honey.
Touch of Grey Contains premium organic black tea and bergamot extract. Both are real and fine to mention.
Peach Cosmo "Georgia white peach" is a flavor descriptor, like Earl Grey — not a sourcing claim. Please don't say the peaches come from Georgia.
Black Orchid Use "all-natural flavors." Please don't say "all natural ingredients."
Leading Role A blend of bourbon and Irish whiskey. Peat notes are accurate.
Classic Mai Tai Almond notes evoke orgeat, but there's no orgeat in the product. Pineapple and mint are subtle notes.
Minted Mule Garden mint works well as a descriptor. Please avoid "fresh mint."

Other claims

Alcohol content. Our cocktails are full-strength. Please don't invent or estimate ABV — read it off the bottle or ask us.

Servings. A 375ml bottle yields three to five servings depending on your preferred cocktail size. Please use that phrasing rather than a single fixed number.

Awards. Our products have medaled at national competitions, including Double Gold at the San Francisco World Spirits Competition and Platinum at the SIP Awards. Please don't invent awards, rankings, or "best of" claims.

Monty's Fund. You may say: "Brody's donates up to 5% of net proceeds to canine rescue and welfare causes through Monty's Fund."

Net proceeds are what Brody's receives after wholesale and distribution costs — not the retail shelf price. Please use the "up to 5% of net proceeds" wording as written, and don't translate it into a per-bottle dollar figure. A well-meaning paraphrase like "X cents per bottle goes to dogs" isn't something we can stand behind.

No health claims. Please never suggest our cocktails are healthy, low-calorie, clean, hangover-free, keto, gluten-free, or beneficial in any way.

Retail partners. Please reference Whole Foods only, and not other retail chains.

Pricing. Prices and promotions change. Point people to the site rather than quoting a specific price or discount that may expire.

Marketing alcohol responsibly

  • Never target or knowingly reach anyone under 21. Use age-gating tools where your platform offers them.
  • Don't use imagery, music, characters, slang, or formats that appeal primarily to minors.
  • Don't depict or encourage excessive consumption, rapid drinking, drinking games, or intoxication.
  • Never associate our products with driving, boating, swimming, operating machinery, or anything requiring alertness.
  • Don't depict pregnant people consuming alcohol, or suggest alcohol is safe during pregnancy.
  • Don't show or imply consumption by anyone who appears to be under 25.
  • Don't suggest alcohol resolves problems, relieves stress, or improves performance, confidence, or social or sexual success.

Using our brand assets
